Accepting these terms
Using namebest.com or creating a NameBest account means you accept these terms. If you are acting for an organisation, you accept them on its behalf and confirm you are allowed to.
If you do not accept them, do not use the service. The console on the public pages is part of the service too.
What the service is
NameBest generates business and domain name candidates from a brief you write, checks each candidate against the domain registry that holds the authoritative record, and returns the verdict with a labelled value estimate on the names that are free.
It is a subscription service. On the Brokerage and Enterprise plans it also includes brokered acquisition, which is buy-side only: we approach the current holder of a name you want and negotiate on your behalf. We never act for a seller, we list nothing for sale and we take no commission on any sale.
It is not a registrar and it is not a marketplace. We do not sell domain names, we hold no inventory, and registering a name is something you do with a registrar, paying their yearly fee for the extension.
What the availability answer means
An availability verdict reports what the registry answered at the moment the lookup ran. Availability changes continuously and a name that was free when you read the row can be registered by somebody else immediately afterwards.
Where a lookup does not complete, the row says so. We do not present a failed lookup as an availability, and you should not act on a row that has not returned a verdict.
We take reasonable care that lookups are accurate, and we cannot guarantee registry uptime, registry accuracy or that any particular name will still be free when you go to register it.
What the value estimate is not
The value estimate is produced by a model from the name itself. It is decision support and it is labelled as an estimate wherever it appears.
It is not an appraisal, not a valuation you can rely on as fact, not an offer from us, and not a prediction of what any name will sell for. Names sell far above and far below such estimates, and most names never sell at all.
Decisions you take on the strength of an estimate are yours.
Names, rights and your responsibility
Names generated for you are yours to use. Generating a name creates no trademark or other intellectual property right in it, for you or for us, and the same or a similar name may be generated for somebody else.
Checking that a name is free to use commercially is your responsibility. That means a trademark search, and, where the business is worth defending, advice from somebody qualified to give it. Nothing on this site is legal advice.
You agree not to use the service to pursue names in bad faith, including to target or extort the holder of an existing trademark.
Your account
You need a valid email address, and you are responsible for what happens under your account. Tell us promptly at [email protected] if you think somebody else has access to it.
On plans with more than one seat, you are responsible for the people you invite and for removing them when they leave.
Acceptable use
Do not attempt to scrape, overload, reverse engineer or circumvent the limits of the service, and do not use automated means to run generations or lookups outside the plan you are on.
Do not resell or redistribute the output as a competing service without a written agreement with us.
Rate limits exist because every result is a live registry query. Working around them is a breach of these terms rather than a clever optimisation.
Fees and billing
Every plan is paid and prices are shown on the pricing page in US dollars, excluding any sales tax due in your country. Plans renew for the term you selected until you cancel.
You can cancel at any time from the account and the plan runs to the end of the period you have paid for. We do not refund part periods except where the law requires it.
Domain registration fees are not part of what you pay us. They are paid to a registrar.
Availability of the service
We work to keep the service up and we may change, suspend or withdraw features as it develops. Registry systems and the model provider are outside our control.
Uptime commitments apply only where they are written into an Enterprise agreement.
Your content
You keep every right in the briefs you write and the shortlists you build. You grant us only the permission needed to operate the service, which means sending a brief to the model that generates candidates and storing what you keep.
We do not use your briefs or shortlists to train models, and we do not sell them. The privacy policy sets out the handling in full.
Disclaimers
To the fullest extent the law allows, the service is provided as it is and as available, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non infringement.
We do not warrant that availability verdicts are uninterrupted or error free, that a name will still be free when you act on it, or that any estimate is accurate.
Limitation of liability
To the maximum extent the law allows, NameBest is not liable for indirect, incidental, special or consequential loss, or for lost profits, data or goodwill, arising from your use of the service. That includes the cost of a name you did not secure.
Our total liability for any claim is limited to the fees you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
Suspension and termination
You can stop using the service at any time. We may suspend or close an account that breaches these terms, does not pay, or puts the service or other users at risk.
On closure your shortlists remain exportable for a reasonable period, and the retention rules in the privacy policy then apply.
Changes to these terms
We may update these terms as the service develops. Material changes update the date on this page and, where they affect you directly, we say so by email. Continuing to use the service after a change means the updated terms apply.
