1. Who we are and how these terms apply
namebest.com and the NameBest service are operated by the administrator of the namebest.com service, reachable at [email protected].
By using the site, creating an account or buying a domain, you accept these terms. If you act for a company or other organization, you confirm that you may accept these terms on its behalf, and "you" means that organization. Domain registrations are also governed by our registration agreement, which takes priority on matters specific to domain names, and by the Renewal Policy, the Transfer Policy, the Acceptable Use Policy and the Privacy Policy.
2. The service
NameBest is a domain reseller. We register domain names through an ICANN accredited registrar that sponsors each registration, and the registry of each extension records the name. Through namebest.com you can:
- search domain names with live availability across many extensions, with the first year price and the renewal price on every result;
- register domains, renew them and transfer them in;
- manage DNS records (A, AAAA, CNAME, MX, TXT, SRV), URL forwarding, custom nameservers, WHOIS privacy where the registry allows it, the transfer lock and the EPP code in your dashboard.
The service is self-serve for individuals, agencies and companies. We do not host websites or email.
3. Your account and its security
You create an account at the cart with your email address and a password, and confirm it with a 6 digit code sent by email. You must give a working email address and keep it current, because renewal reminders, verification links and transfer approvals are sent there. You must be at least 18 years old, or the age of majority where you live, to buy a domain.
You are responsible for keeping your password secret and for all actions taken in your account. Tell us at once at [email protected] if you suspect unauthorized access. Our guide to domain account security lists the steps that protect your domains.
4. Prices, currency and taxes
Prices are shown live in US dollars in search results, on the pricing page, in the cart and at checkout. For each extension we show the first year price and the renewal price before you pay. Premium domains have individual prices set by the registry, shown in the search result.
Taxes such as VAT or sales tax are added where the law requires it, based on your billing details, and are shown before you confirm payment. Payments are taken by card through our payment processor. You authorize us to charge the payment method in your account for the items you buy and for automatic renewals. Registries can change their wholesale prices. A changed renewal price applies only to renewals after the change and is shown in the dashboard and reminder emails before the renewal date.
5. Yearly subscriptions with auto renew
Each domain is a yearly subscription, or a longer term where the registry requires it, for example two years for .ai. Auto renew is on by default. Before the end of each term we charge the renewal price for the next term to your saved payment method. We remind you 30 days and 7 days before expiry and after expiry.
6. Cancellation
To cancel a domain subscription, switch auto renew off for that domain in your dashboard. The domain then stays registered to you until the end of the term you have paid for and is not charged again. You can switch auto renew back on at any time before the domain is deleted. You can also transfer a domain to another registrar at any time outside the lock periods, at no charge from us. What happens after expiry is described in the Renewal Policy.
7. Refunds
A completed registration, renewal or transfer in is recorded at the registry and cannot be returned to it, so it is not refundable. By completing checkout you ask us to start the registration at once, and you acknowledge that, where the law allows it, you lose any right to withdraw once the registration has been completed.
If a registration, renewal or transfer in fails, for example because someone else registered the name between your search and the payment, because the EPP code was wrong, or because of a registry error, the amount for that domain is returned to the original payment method, normally within 5 business days. Domains suspended or cancelled for breach of the Acceptable Use Policy or lost in a dispute are not refunded. Details are in our domain refund policy. Mandatory consumer rights in your country are not affected.
All other payments are final. Apart from a failed registration, renewal or transfer, money is returned only for a double charge or for an unauthorised charge that you report within 14 days and that the order and payment records confirm. Opening a chargeback without contacting us first is a breach of these Terms and the account is closed permanently.
8. Acceptable use
You must use the site, your account and your domains lawfully and in line with our Acceptable Use Policy. You must not attack, overload or scrape the site or the search, use automated tools to register names in bulk in a way that harms other users, try to access other accounts, or use stolen payment details. We may limit searches from a single source to protect the service.
9. Intellectual property
The site, its design, text, logos and software belong to NameBest or its licensors and are protected by law. You may use the site only to search for, buy and manage domains. Registering a domain does not give you rights in any trademark, and it does not give us any rights in your domain or in the content you publish at it.
10. Disclaimers
We work to keep the site and the services available and accurate, but they are provided as they are and as available. Availability results come live from the registries and can change between a search and a registration. We do not guarantee that a domain is free from trademark claims, that it will rank in search engines, or that the service will be uninterrupted. We are not responsible for outages of registries, the sponsoring registrar or third party networks outside our control.
11. Limitation of liability
To the extent the law allows, NameBest is not liable for indirect or consequential losses, lost profits, lost revenue, lost data or loss of goodwill. Our total liability for all claims connected with the service in any twelve month period is limited to the amount you paid us in the twelve months before the event giving rise to the claim. These limits do not apply to liability that cannot be limited by law, including liability for intent, gross negligence, or death or personal injury, and they do not affect your mandatory rights as a consumer.
You agree to indemnify NameBest against claims by third parties arising from your domains, their content or your breach of these terms, as further described in the registration agreement.
12. Suspension and termination
You can close your account at any time by writing to [email protected] after you have transferred out or let expire the domains you want to keep. We may suspend or close your account, or suspend individual domains, if you seriously or repeatedly breach these terms, the registration agreement or the Acceptable Use Policy, if payments are reversed or fraudulent, or if the law or an authority requires it. Where it is lawful and practical, we give you notice and time to transfer your domains out first.
13. Governing law and courts
These terms and any dispute about them or about the service are governed by the law of Poland. The courts competent for the registered seat of the operator of NameBest have jurisdiction. If you are a consumer, you keep the protection of the mandatory consumer laws of your country of residence, and you may also bring a claim before the courts of your country where the law gives you that right. Disputes about the registration of a domain name in relation to trademarks are also subject to the procedures described on our UDRP page.
14. Changes to these terms
We may change these terms when our services, the law or ICANN and registry policies change. We publish the new version on this page with its effective date and email account holders about material changes at least 30 days before they apply. If you do not agree, you can switch auto renew off or transfer your domains out before the change applies.
